This course is designed to enable practitioners working with young people to develop their knowledge and skills in relation to the application of the Mental Capacity Act 2005 (‘the MCA 2005’) to their work. The MCA 2005 will be relevant to young people aged 16 and over who lack capacity to make decisions for themselves, as well as parents who lack capacity to make decisions in relation to their children. Recent cases have highlighted the importance of the MCA 2005 in areas such as treatment decisions, the exercise of parental responsibility, admission to hospital and deprivation of liberty.
The course will include the following key topics:
• Consent in under 16’s
• Consent and capacity framework for 16-17 year olds
• The scope of parental responsibility
• Application of the MCA to 16-17 years olds
• Supporting young people to make decisions
• An overview of the MCA 2005- principles, assessment of capacity and determining best interests
• Exceptions, the parts that do not apply to those aged 16-17
• The relationship between the MCA and the Children’s Act 1989
• Legal proceeding involving young people aged 16-17
• Questions, summary & evaluation
Learning outcomes
By the end of the course participants will have
• Understand how to gain consent from children
• Improved their knowledge and understanding of the Mental Capacity Act 2005 generally and, in particular, its application to under 18s
