This 1-day training programme is specifically for employees in the council's HR teams (Casework and Change Team, and Integra).

The course will provide an overview of TUPE Regulations. It will focus on the law in this area, on public sector TUPE in and out, and between Public Sector organisations.

Learning outcomes
The course will include:

* Understanding when TUPE applies, who and what transfers (defining who is in scope and subsequent change control).
* Understanding what is a service provision change and when ‘fragmentation’ may occur.
* Employees’ rights
* Pensions: including Cabinet Office Fair Deal for Pensions, New Fair Deal, LGPS issues, role of GAD.
* 2nd and 3rd generation TUPE situations – what factors need to be determined early.
* Employment liabilities inherited by new employer
* Which employer is liable for dismissals
* Consultation and TU recognition 
* Pre and Post transfer redundancies
* Varying employment contracts following transfer
* Changing structures/re-organisations
* HR issues; e.g. information to be provided by transfer or information provided by transferee (any special measures); Due Diligence process and timing (salary protection/red circling/future pay awards/static pay on transfer/personal files)
* Tactics when inviting or bidding for tenders
* Practical considerations for managing transfers (planning for a transfer/post transfer)
