This course will provide an introduction to the Mental Capacity Act 2005 (MCA) for staff in front-line caring roles.
The course gives many practical examples of how we apply the principles of the MCA in our day-to-day work and how this links to our practice values. It outlines the legal knowledge needed to understand when the MCA applies or does not. Your responsibilities for seeking advice and support to take formal steps will also be addressed.
Learning outcomes
On completion of this half-day session, delegates will be able to:
- Outline the 5 principles of the Mental Capacity Act 2005 and apply them in your engagement with adults.
- Describe how the Act supports our right to make our own decisions and provides a legal framework for others to make decisions for us.
- Understand how the Act links to our rights to liberty and right to respect for private and family life in the Human Rights Act 1998.
- Identify of the range of decisions this relates to, including personal life, health and social care and depriving someone of their liberty.
- Provide examples of reasons for questioning a person’s mental capacity to make a specific decision and what actions may need to be taken by you or others.
- Recognise how to support people to make decisions in their day-to-day lives and, when this is not possible, how a best interests decision may be made for them.
